The Difference Between Felony And Misdemeanor DWI

Standard DUI is a misdemeanor in New York state, but there are more serious drunk driving charges that include a potential prison sentence of more than one year – the definition of a felony. One example is a repeat offense of DWI, aggravated DWI (driving with a blood-alcohol content of 0.18 or higher) or driving while alcohol impaired (DWAI, or driving with a BAC below 0.07 but above 0.05). A second or subsequent offense of any of these crimes within a 10-year period is considered a felony in New York, with penalties as follows:

  • Aggravated DWI, second offense: up to four years in jail, driver’s license suspension of at least 18 months, fine of $1,000 – 5,000
  • Aggravated DWI, third offense: up to seven years in jail, driver’s license suspension of at least 18 months, fine of $2,000 – 10,000
  • DWI/DWAI, second offense: up to four years in jail, driver’s license suspension of at least 12 months, fine of $1,000 – 5,000
  • DWI/DWAI, third offense: up to seven years in jail, driver’s license suspension of at least 12 months, fine of $2,000 – 10,000
